Terms of use shows as New item

In my join page, the are that says, " I have read and agreed to the Term of Use" has a caption of "New Item".  I have tried all day to fix this through the data base without luck. Can anyone help

You can remove the text by editing the profile field from Administration > Builders > Profile Fields.

I wish it was that easy. This is a system file and has nothing that says "New item" on either the profile field or database.  Any help please!!!!
