Banner slides over site

when a right hand side banner is set and the client browser window is smaller then the site, the banner slides over the site and is immovable. Part of the site cannot be used.

did not find this issue in trac.

I have this issue in 2 instances of dolphin running

checked with Chrome, FF, IE: all same issue

The banner is called through admin => Tools => Banners (Settings in attachment)

The problem is that the banner slides over the site like a top layer. It should be fixed next to the column

bug is located on every page.

I have no known fix (that's why I'm here)
